## Acceptance

Using Nearily means you accept these terms.

## Description of service

Nearily is a coffee loyalty and subscription platform. Access points: iOS app, website (nearily.com), Neo Telegram bot (@nearily_bot), operator dashboard (plus.nearily.com).

## Eligibility

Users must be **16 or older**.

## Account registration

- Phone number required
- One account per person
- Accurate information required

## Loyalty program

- Stamps are earned through QR-verified purchases at partner cafes
- Stamps are non-transferable, have no monetary value
- Rewards are subject to availability
- Nearily may void stamps for fraud

## Cashback program

- Cashback percentages are set by individual cafes
- Cashback is cafe-specific and non-transferable
- Nearily is not responsible for cashback redemption at individual cafes

## Subscriptions

- Daily redemption limits apply per tier
- Non-refundable for the current billing period
- Cancel anytime — unused daily redemptions do not carry over

## User conduct

Prohibited:
- Unlawful use
- Manipulation or fraud
- Sharing QR codes between users
- Multiple accounts
- Harassment of other users or staff
- Inappropriate content
- Reverse engineering
- Damaging server infrastructure

## Partner cafes

Partner cafes are independent businesses. Nearily is not responsible for product quality or availability at individual cafes. Disputes are resolved with the cafe directly. Stamps may be voided if a cafe leaves the network.

## Intellectual property

Nearily owns its name, logo, and design. Users grant Nearily a license to post user-contributed content (reviews, profile data) inside the service.

## Limitation of liability

Service provided "as is" with no warranties. Liability is limited to the maximum permitted by law.

## Termination

Nearily may suspend or terminate accounts for violations.

## Dispute resolution

Good-faith negotiation first. Otherwise, resolution in competent courts.

## Modifications

Material changes receive 14-day notice.
